Catherine Naltsas secured an early win for her natural toothpaste client defending a potential class action lawsuit in the Northern District of California. Plaintiffs alleged that the natural toothpaste product contained PFAS. Pre-suit, it was determined through testing of the lots of tube toothpaste and expert analysis that the tube toothpaste product contained no PFAS. Lynberg & Watkins took an aggressive litigation posture challenging the reasonableness of the pre-suit inquiry by plaintiffs required by Federal Rule of Civil Procedure 11 resulting in a voluntary dismissal by plaintiffs. This was a great result and monumental defense cost saving for the client.
