Congratulations to Trevor Resurreccion and Bradley Wilson on their recent victory representing a general contractor before the California Court of Appeal, Fourth Appellate District. The underlying lawsuit involves a multi-party dispute arising out of the failed construction of a hotel project in the Coachella Valley. The trial court dismissed the general contractor client’s cross-complaint against a construction lender’s representative and agent in which the general contractor asserted claims for fraud based upon intentional misrepresentation and concealment. The Court of Appeal reversed the trial court’s order of dismissal, finding that general contractor had alleged sufficient facts to state the fraud claims.
